The Alabama Court of Civil Appeals reversed a 2023 ruling by the Baldwin County Circuit Court in 2023 that compelled former Baldwin County Sheriff Hoss Mack to return a 1968 Chevrolet Camaro deputies seized.
According to Mobile's Fox10 News, Baldwin County Circuit Judge Clark Stankoski originally concluded the Sheriff's Office took Thomas Hadley's 1968 Chevrolet Camaro through an "extra-judicial action."
A Kansas man had reported the vehicle as stolen in 2003. An attorney for Hadley also argued the warrant wasn't valid because the five-year window for prosecuting a receiving stolen property offense had passed, according to the outlet.
The Alabama Court of Civil Appeals unanimously reversed and remanded the Baldwin County Circuit Court's ruling on Friday.
"Based on the express language of the judgment, it is clear that the trial court did not make a finding of whether Hadley was entitled to lawful possession of the automobile. Therefore, the trial court erred in directing Mack to return the automobile to Hadley, and the trial court's judgment with respect to Mack is reversed, and the cause is remanded," Alabama Court of Civil Appeals Judge Bill Lewis said in an opinion issued on Friday.
