The Mobile County Sheriff’s Office announced the bodies of three people were found in Summerdale nearly six weeks after they were reported missing.
Aurelia Choc Cac, 40; her daughter, Niurka, 17; and her two-year-old son, Anthony, were last seen on January 30 at their Theodore home. They were found dead on Wednesday with the assistance of federal authorities and the Baldwin County Sheriff's Office.
Hector Gamaliel Argueta-Guerra is charged with three counts of capital murder in the course of kidnapping, three counts of capital murder during the course of burglary, capital murder for the death of two or more people, capital murder in the death of a child under 14, three counts of abuse of a corpse and obstruction of justice for providing a false identification to law enforcement in order to prevent an investigation.
Mobile County District Attorney Keith Blackwood said the state would seek the death penalty. Sheriff Paul Burch said Argueta-Guerra was in the United States illegally.
“We wouldn’t be standing here today if this defendant, who has an extensive, violent history, was not released by the Biden administration in 2021," said Burch. "So, Biden, Harris, Mayorkas and Merrick have the blood of this family on their hands."
The cause of death has not been determined. Autopsies will be performed.
Another man, Silverio Garcia, 60, was arrested on February 3 and charged with being a certain person forbidden to possess a pistol, in connection to the case.
Mobile County Sheriff Paul Burch said the suspects are connected to a network of painting companies in the area.
