Alabama Department of Transportation (ALDOT) director John Cooper and his neighbor in North Alabama reached an agreement Thursday following a disagreement over an easement.

Arguments over the easement led to the arrest of Cooper after the neighbor, Gerald Carter, accused him of threatening to shoot him. Carter claimed he had rights to the easement, but Cooper barred him from entering.

In the name of his company, South Sauty Creek Resort, Inc., Cooper filed a civil lawsuit asking a judge to recognize Carter did not have a legal conveyance to the easement.

Marshall County Circuit Judge Christopher Abel ruled in favor of Cooper after the parties reached an agreement, and a new easement was created for Carter.

Carter asked Marshall County District Judge Mitchell S. Floyd to dismiss the criminal charge against Cooper. The judge approved the motion and ordered the case dismissed without charge.
