The Supreme Court of Alabama ruled a Baldwin County court’s declaratory judgment in favor of a developer suing Orange Beach was deemed void due to lack of subject-matter jurisdiction.
According to court documents, Ian Boles filed a lawsuit in 2015 after the city refused inspections because Boles refused to submit subcontractor financial information. Boles already owned several vacation rental properties on the Gulf.
The Court previously overturned a $3.7 million damages verdict against the city, noting that Boles had received the inspections he sought; therefore, the issue had been resolved.
On Friday, the Court ruled the declaratory judgment claim was moot since the issue had been resolved. The court also remanded the case for the trial court to enter an order of dismissal.
