A Baldwin County jury found a Foley man guilty of secretly recording a child changing clothes in a bathroom.

James Funderburg was convicted of the production of obscene material involving a minor.

The Baldwin County Sheriff’s Office began the investigation in 2024. The victim was a relative of Funderburg and was living in his home at the time the crime occurred, detectives said. According to a complaint, the child was under the age of 17.

The case was prosecuted by Sydney Corello and Courtney Day with the Baldwin County District Attorney’s Office.

“This successful outcome was made possible through the collaborative efforts of the Baldwin County Sheriff’s Office Violent Crimes Unit and Digital Forensics Unit, the Baldwin County District Attorney’s Office, the Child Advocacy Center, and the Department of Human Resources,” the sheriff’s office stated following the verdict.

Funderburg’s bond was revoked and he was ordered to jail to await sentencing, which was set for July 15.
