Immigration and Customs Enforcement (ICE) recently placed a detainer on a man accused of leaving the scene of an accident with a personal injury in December. 

According to the Madison County Sheriff’s Office, ICE recently placed a detainer hold on Gustavo Sanchez Montoya, 28. Per ICE, an immigration hold is a request from U.S. Immigration and Customs Enforcement to state or local law enforcement agencies to notify ICE as early as possible before a possible illegal alien is released from their custody.

Montoya was arrested by Huntsville police after he allegedly left the scene of an accident with a personal injury on December 8, according to WHNT.

According to court records, Richard Jensen, Montoya’s attorney, is challenging his client’s detention.

“The Defendant was arrested on December 8, 2024 and accused of Leaving the Scene of an Accident/Death and Assault 2nd Degree. He has been held in the Madison County Jail since that date. To date no charging document or case file exists for the Leaving the Scene of an Accident/Death accusation. To date no charging document exists for the above-captioned matter re the Assault 2nd Degree accusation. The Defendant is being held without probable cause and without substantive or procedural due process of law,” Jensen said in a court filing on Tuesday in Madison County District Court.
