A Mobile man charged with intentional murder in the death of a man who was dragged under a vehicle pleaded not guilty.

Attorneys for Jacob Cross, 30, said their client did not intend to kill the victim, 57-year-old Sam Walker. Cross was seen crying in court on Thursday during his arraignment.

Fox 10 obtained video showing the two men fighting at the Circle K at Schillinger Road and Three Notch Road on October 8. A surveillance video from across the street then shows an SUV leaving the scene.

Defense attorneys said Cross did not know Walker before the fight. Prosecutors said the argument started after Cross got into an argument with his girlfriend, and Walker asked her if she was okay. Video shows Cross attempted to leave, but Walker tried to jump in the car. Attorneys admit Cross hit Walker with his vehicle but said he had no idea the victim was under his SUV when he left the scene.

When Cross returned home, two miles from the gas station, he realized the man was still under his vehicle and called 911, attorneys claim. He was arrested and placed in jail on a $500,000 bond. He is also charged with leaving the scene of an accident.

Cross is considered innocent until proven guilty. He is set for a preliminary hearing on November 13.
