After Montgomery County Circuit Judge Brooke Reid dismissed a lawsuit against U.S. Sen. Tommy Tuberville (R-Auburn) on Thursday, the 2026 campaign to be Alabama’s governor will now be about the issues and not “political games and frivolous lawsuits,” according to Alabama Republican Party chairman Scott Stadthagen.

The lawsuit filed by Barry Ragsdale alleged Tuberville is constitutionally prohibited from serving as governor "because he fails to satisfy the seven-year durational residency requirement contained in the Alabama Constitution."

However, Reid ruled on Thursday that she didn’t have jurisdiction over the issue and dismissed the case

Stadthagen said in a statement on Thursday, “For months, we’ve watched political opponents try to accomplish in the courtroom what they couldn’t accomplish at the ballot box. With today’s dismissal, it’s finally time to turn the page.”

“Now Democrats like Doug Jones have to do what every candidate should do: stand on their record, explain their agenda, and make their case to the people of Alabama. Republicans are proud of our record of conservative leadership and we’ve BEEN ready to have that conversation,” he added. “Alabamians deserve a campaign about the issues…not one built around political games and frivolous lawsuits.”

The ruling will likely be appealed to the Alabama Supreme Court.
