U.S. Sen. Tommy Tuberville (R-Auburn) is backing legislation that would require the death penalty for illegal aliens convicted of murdering an American citizen.

The Justice for American Victims of Illegal Aliens Act would codify President Donald Trump’s executive order into law, subjecting illegal immigrants who kill American citizens to the death penalty.

Tuberville joined the bill’s cosponsors: U.S. Sens. John Cornyn (R-Texas), Steve Daines (R-Mont.) and Tim Scott (R-S.C.) for a press conference about the bill on Thursday.

“Over the past four years, the Biden/Harris administration has welcomed over 10 million illegal immigrants into our country with open arms,” Tuberville said. “It wasn’t like there was any resistance. Many of these people are murders, rapist, terrorists, you name it. We’ve got a problem with it.”

“It’s simple: if you're in this country illegally and you murder an American citizen, you face the death penalty," he added. "You know, we have to stop incentivizing crime in this country. It’s rampant.”

Trump signed the executive order in January, directing the attorney general to ensure capital punishment is made readily available to the states and to pursue the death penalty where possible. The order also blamed the Biden administration for subverting capital punishment.

“These efforts to subvert and undermine capital punishment defy the laws of our nation, make a mockery of justice, and insult the victims of these horrible crimes,” the order read. “The Government’s most solemn responsibility is to protect its citizens from abhorrent acts, and my Administration will not tolerate efforts to stymie and eviscerate the laws that authorize capital punishment against those who commit horrible acts of violence against American citizens.”

The Justice for American Victims of Illegal Aliens Act would:

  • Amend the Criminal Code to create a new aggravating factor for illegal immigrants who murder U.S. citizens
  • Help direct juries to administer the death penalty when an illegal immigrant murders a U.S. citizen
  • Fully implement and permanently codify President Trump’s Jan. 20, 2025 Executive Order, “Restoring the Death Penalty and Protecting Public Safety,” specifically Section 3(b)(i) of the Executive Order, which states that the “Attorney General shall, where consistent with applicable law, pursue Federal jurisdiction and seek the death penalty regardless of other factors for every federal capital crime involving … [a] capital crime committed by an alien illegally present in this country.”
