Middle District of Alabama U.S. District Judge Kristi DuBose on Friday dismissed remaining claims in a lawsuit brought by former Montgomery Police chief Ernest Finley against the City of Montgomery and Montgomery Mayor Steven Reed.
Finley was the chief of police at the Montgomery Police Department from 2015 to 2021. Finley filed a lawsuit in March 2023 alleging the city discriminated against, retaliated against, and conspired against him and ultimately forced him to resign because of his race.
DuBose said in an order granting the City of Montgomery's motion for summary judgment, "Finley has not shown evidence of a conspiracy against him."
"(Marcus) Webster filed an ethics complaint against Finley and Reaves. There is no evidence indicating that Webster's complaint involved a conspiracy with the (Alabama Ethics Commission). There is also no evidence that the City or Reed conspired with the AEC regarding the complaint. In fact, the City Attorney told the AEC that the City believed there were no ethics violations, and the City paid for legal representation to defend Finley and (Jennifer) Reaves. Therefore, no reasonable jury could find that the City conspired against Finley to violate his civil rights," Dubose said in the order. "The City moved for summary judgment on all of the remaining claims against it. Finley failed to respond to the motion. Because the City's motion and evidentiary materials show that no reasonable jury could find for Finley on any of the claims against the City, the City's motion for summary judgment is GRANTED."
