Members of the Montgomery City Council will consider repealing a controversial recently passed ordinance requiring anyone with a concealed firearm to have a photo ID.

The Alabama Legislature removed the requirement to have a permit for concealed firearms in 2023. 

Montgomery's new ordinance passed in September allows police to confiscate concealed guns if the gun holder does not present a photo ID. The gun owner would not get it back unless they paid a fine and provided proof of purchase within 30 days.

A spokesman for Attorney General Steve Marshall said in September the ordinance is illegal.

According to an agenda for the council’s Tuesday meeting, Montgomery City Councilman Glen Pruitt is now sponsoring an ordinance repealing the photo ID requirement ordinance he sponsored last month.

Pruitt is also sponsoring a resolution “encouraging all supporting municipalities to adopt a resolution encouraging Alabama Legislature to adopt legislation supporting photo identification for concealed carry and providing penalties.
