A Montgomery man has been charged with capital murder in the death of a man investigators believe was killed during a sexual assault.

Barry Freeman, 51, is charged with capital murder – rape/sodomy.

According to a deposition, the victim, David Crowe, a 59-year-old white man, was killed early Saturday. Investigators believe Crowe was punched in the throat by the suspect after he refused sexual advances. Documents state the victim was rendered unconscious, at which time the suspect forcibly performed sexual intercourse.

The incident occurred in the area of 120 Dexter Avenue in Montgomery.

The victim was pronounced dead by a Baptist South doctor.

Freeman is being held in the Montgomery County Detention Facility without bond. He is considered innocent until proven guilty.
