MONTGOMERY — The Alabama Senate on Thursday passed legislation that declares the state will recognize only two sexes, male and female.

Senate Bill 79, sponsored by State Sen. April Weaver (R-Brierfield), establishes definitions for sex-based terms under state law, including boy, girl, man, woman, father, mother, male and female.

The legislation defines males and females based on biological reproductive organs.

“Sex is based on fundamental truths that are as old as the book of Genesis and as reliable as the sun in the sky,” Weaver said. “Men are born men, and women are born women—one can never become the other.”

She continued, “Sex definitions are rooted in proven fact and indisputable biology rather than the dangerous cultural war being waged on Alabama values.” 

“This bill injects a strong dose of common sense into the woke agenda that has become increasingly absurd with the passage of time,” Weaver added.

The vote comes just two days after Gov. Kay Ivey announced her intention to sign the “What is a Woman” bill into law.

SB79 passed the Alabama Senate with a vote of 26 yes votes and five Democrats opposing.

State Sen. Rodger Smitherman (D-Birmingham) filibustered the bill for hours and compared the legislation to Jim Crow laws.

“Discrimination is alive and well,” Smitherman said.

State Rep. Susan DuBose (R-Hoover) filed similar legislation in the House in 2024 and 2025.
