The appeal of a former Decatur Police officer charged with murder in the September 2023 shooting death of Stephen Perkins did not take as long as expected.

Mac Bailey Marquette appealed a lower court’s ruling in his "stand your ground" hearing. Marquette claimed self-defense in the Morgan County case. Circuit Judge Charles Elliott denied Marquette immunity.

Upon appeal in April, it was thought that a decision by the Court of Criminal Appeals would take approximately seven months. However, the appeals court ruled Elliott’s decision was not made in error.

Perkins' family has filed a federal wrongful death lawsuit.
