A Lee County man is currently being held on an Immigration and Customs Enforcement (ICE) hold after being charged with first-degree rape for allegedly assaulting a woman who was “incapable of consent by reason of being physically helpless or mentally incapacitated.”
Erin Roelmer Ramos-Perez, 24, was arrested and placed in the Lee County Jail on Sunday. He is charged with first-degree rape and is being held without bond. Court records state the alleged offense occurred in Opelika on the same day of his arrest.
The criminal complaint accuses Ramos-Perez of having sexual intercourse with a woman who was “incapable of consent by reason of being physically helpless or mentally incapacitated.” It further alleges that the act occurred while the victim was asleep.
Ramos-Perez’s ICE detainer means authorities believe he is in the country illegally, and federal authorities are trying to confirm his immigration status.
Ramos-Perez is the second illegal alien in Opelika to be charged with rape this month.
Artemio Garcia Perez, 20, was arrested by the U.S. Department of Homeland Security and U.S. Customs and Border Protection (CBP) at Hartsfield-Jackson Atlanta International Airport earlier this month while attempting to flee the country. He was extradited to Lee County, where he will be charged with first-degree rape, according to Opelika Police.
